Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before accessing our mobile app or our website (the “Service”), operated by Best of the City Perks (“us”, “we”, or “our”). The website is located at http://bestofthecityperks.com. By downloading or using the Service, you agree to accept all terms and conditions written here. You are prohibited from using the Service if you disagree with any of these Terms and Conditions.
We are offering you the Service to use for your own personal use without cost, but you should be aware that you cannot send it on to anyone else, and you’re not allowed to copy, or modify the Service or any part of the Service, in any way. You’re not allowed to use the Service in any way that is or may be damaging to the Service or in any way that impacts user access to the Service. You’re not allowed to use the Service contrary to applicable laws and regulations, or in any way that may cause harm to any person or business entity. You’re not allowed to engage in any data mining, data harvesting, data extracting or any other similar activity in relation to the Service, or use the materials for any commercial purpose, or for any public display (commercial or non-commercial) without our express written consent. You’re not allowed to use, copy or modify the logo or trademark in any way. You’re not allowed to attempt to extract the source code of the Service, and you also can’t translate the Service into other languages, or make derivative versions. The Service itself, and all the trademarks, copyrights, database rights and other intellectual property rights related to it, belong to Best of the City Perks.
We endeavor to provide content that is accurate and reliable, however, the content is presented “as is” and “as available” and we make no representation or warranty regarding the accuracy of the content accessible on or through the Service. The materials appearing on the Service could include technical or typographical errors. Best of the City Perks does not warrant that any of the materials on the Service are accurate, complete or current. We are not liable for any damages arising out of or in connection with the use or performance of the Service.
Your use of the Service indicates your agreement to the following terms for redeeming discount offers as an active Best of the City Perks member.
1. One discount per business per day at participating locations, unless stated otherwise.
2. Key tag is only valid for one member and may not be shared.
3. You must present the physical key tag at the time of purchase. Digital reproductions, displaying your key tag through an app that digitally stores key tags, or only displaying the discount offer on the app are not acceptable for redeeming a discount offer.
4. Discounts are off regular priced items.
5. Your Best of the City Perks discount is not valid with any other offer, discount or special.
6. With “Buy one, Get one free” offers, free item is of equal or lesser value.
7. Limit one discount per visit when a business offers more than one discount, unless stated otherwise.
8. Tax and gratuity not included.
9. Valid only at participating locations.
10. Not valid after expiration date on key tag.
11. Discount offers are subject to change at any time.
You should be aware that there are certain things that Best of the City Perks will not take responsibility for. We are not responsible for the quality of any product or service purchased from or provided by any of the businesses listed on the Service, nor do we endorse or guarantee any service or product from any of the businesses listed on the Service. You agree to not hold Best of the City Perks, its officers, directors, employees or representatives liable for any damages or injury from, or defectiveness of any product or service received from any business listed on the Service, whether you paid for that product or service or received it free of charge.
We may terminate or suspend your Best of the City Perks membership immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms & Conditions. Upon termination, your right to use the Service will immediately cease. You hereby indemnify to the fullest extent Best of the City Perks from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms & Conditions.
We may revise these Terms & Conditions for the Service at any time without notice, and by using the Service you are expected to review these Terms and Conditions on a regular basis.
At some point we may choose to update the Service. We do not promise that we will always update the Service so that it is relevant to you and/or works with the Mac/Windows version or iOS/Android version that you have installed on your device. However, you agree to always accept updates to the application when offered to you. We may also wish to stop providing the Service, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the Service, and (if needed) delete it from your device.
Best of the City Perks is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.
These Terms constitute the entire agreement between Best of the City Perks and you in relation to your use of this Service, and supersede all prior agreements and understandings. These Terms & Conditions will be governed by and interpreted in accordance with the laws of each state, and you submit to the non-exclusive jurisdiction of each state’s court and federal courts for the resolution of any disputes. If any provision of these Terms & Conditions is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.
